Terms of Service

1. Introduction

Welcome to Hide (hereinafter: "the App"). The App is developed and provided by a small business (BV/VOF), established in the Netherlands (hereinafter: "we", "us" or "the Provider"). By downloading, installing or using the App, you agree to these Terms of Service. Please read these terms carefully before using the App.

Hide is a location-based hide-and-seek game. Participants are divided into two teams: Hunters and Runners. Runners share their GPS location at a configurable time interval; Hunters receive these updates and try to find the Runners.

2. Applicability

These Terms of Service apply to all users of the App, regardless of role. By using the App, you confirm that you:

  • Are at least 13 years old, or meet the legally required minimum age in your country;
  • If under the age of majority: have the consent and supervision of a parent or legal guardian;
  • Are authorised to enter into an agreement on your own behalf or on behalf of your organisation;
  • Agree to these terms and our privacy policy.

3. Description of the App

Hide offers the following features:

  • Create or join a game session;
  • Assignment to the Hunters or Runners team;
  • Runners share their GPS location at a configurable time interval;
  • Hunters receive location updates from Runners via the App;
  • Management of game parameters such as the location interval.

4. Safety — Important

DO NOT use the App while driving, cycling, or in any situation requiring your full attention. Always pay attention to your surroundings when using the App. You are at all times solely responsible for your own safety and that of others.

By using the App you acknowledge that:

  • Location, heading, and distance data may be delayed, inaccurate, or incorrect;
  • The App is for entertainment purposes only and is not intended for navigation, emergency, or safety-critical use;
  • You are responsible for your surroundings and your own decisions;
  • You must not trespass, enter restricted areas, or violate any law.

We are not liable for personal injury, property damage, or any other incident arising from the use of the App or participation in the game. The Provider accepts no responsibility whatsoever for damages of any kind occurring during or as a result of using the App.

5. Location Tracking

5.1 Consent

For the App to function, access to the GPS location of your device is required. By participating as a Runner, you explicitly consent to sharing your location with the Hunters within your game session, for the duration of the game.

5.2 Interval and Control

Location is not shared continuously, but at a configurable time interval. The game organiser or Runner can set this interval within the App. Outside an active game session, your location is not shared or stored.

5.3 Accuracy

GPS location data may be delayed or inaccurate due to technical limitations (signal strength, network, device). We make no guarantees regarding the accuracy or completeness of location data.

5.4 Third Parties

Your location data is shared exclusively with the Hunters in your active game session. We do not sell or provide your location data to third parties for commercial purposes.

6. Processing of Personal Data (GDPR)

We process your personal data in accordance with the General Data Protection Regulation (GDPR) and applicable Dutch legislation. The following data may be processed:

  • Username or name;
  • Email address (if provided upon registration);
  • GPS location data (exclusively during active game sessions);
  • Device information and technical log data.

Location data stored as part of match history is retained for a maximum of 7 days after the game session ends, after which it is automatically deleted. Other personal data is not retained longer than necessary for the purpose for which it was collected. You may exercise your rights at any time (access, correction, deletion) via the contact details in Article 14.

6.1 Match History and Sharing with Friends

After a game session ends, a summary of in-game locations is saved as match history. This match history is visible to users you have added as a friend within the App. You control who you add as a friend. By adding someone as a friend, you consent to that person being able to view your match history.

Match history data is automatically deleted after 7 days. We do not share this data with third parties outside your friends list.

7. Accounts and Security

Certain features require an account. You are responsible for:

  • Keeping your login credentials and device secure;
  • All activity under your account;
  • Providing accurate information to the App.

We reserve the right to refuse, suspend, or terminate accounts to protect the App, other users, or ourselves, or where required by law.

8. Acceptable Use

You agree not to use the App for:

  • Illegal purposes or encouraging others to do so;
  • Harassing, threatening, or insulting other users;
  • Impersonating others or misrepresenting your identity;
  • Cheating, including GPS spoofing, automation, or circumventing game rules;
  • Interfering with or overloading the App;
  • Misusing personal or location data of other players.

We may enforce violations at our discretion, including by removing content, restricting features, or suspending or terminating accounts.

9. Intellectual Property

All rights in the App — including software, design, branding, and the name "Hide" — belong to the Provider or its licensors. You receive a limited, personal, revocable, non-transferable licence for non-commercial use of the App.

You may not copy, modify, distribute, sell, or reverse-engineer the App, except to the extent permitted by mandatory law.

10. Availability and Changes

We aim for the highest possible availability but do not guarantee uninterrupted operation. We reserve the right to modify, limit, suspend, or discontinue any part of the App at any time. We are not liable for damages resulting from unavailability.

11. Termination

You may stop using the App at any time by deleting it from your device. We may suspend or terminate your access at any time, with or without notice, including for suspected violations of these Terms, fraud, security issues, or legal compliance.

12. Changes to These Terms

We may update these Terms from time to time. For material changes, we will notify you via the App or by email. Continued use after the effective date of updated Terms constitutes acceptance. The most current version is always available via the App.

13. Governing Law and Disputes

These Terms are governed by Dutch law. Any disputes will be submitted to the competent court in the district where the Provider is established, unless mandatory law provides otherwise.

Gebruiksvoorwaarden

1. Inleiding

Welkom bij Hide (hierna: "de App"). De App is ontwikkeld en aangeboden door een kleine onderneming (BV/VOF), gevestigd in Nederland (hierna: "wij", "ons" of "de Aanbieder"). Door de App te downloaden, installeren of te gebruiken, gaat u akkoord met deze Gebruiksvoorwaarden. Lees deze voorwaarden zorgvuldig voordat u de App gebruikt.

Hide is een locatiegebaseerd verstoppertje-spel. Deelnemers worden ingedeeld in twee teams: Jagers en Renners. Renners delen hun GPS-locatie op een instelbaar tijdsinterval; Jagers ontvangen deze updates en proberen de Renners te vinden.

2. Toepasbaarheid

Deze Gebruiksvoorwaarden zijn van toepassing op alle gebruikers van de App, ongeacht hun rol. Door de App te gebruiken bevestigt u dat u:

  • Ten minste 13 jaar oud bent, of de wettelijk vereiste minimumleeftijd in uw land;
  • Indien jonger dan de meerderjarigheidsleeftijd: toestemming en begeleiding heeft van een ouder of wettelijke voogd;
  • Bevoegd bent om namens uzelf of uw organisatie een overeenkomst aan te gaan;
  • Akkoord gaat met deze voorwaarden en ons privacybeleid.

3. Beschrijving van de App

Hide biedt de volgende functionaliteiten:

  • Aanmaken van of deelnemen aan een spelsessie;
  • Toewijzing aan het team Jagers of Renners;
  • Renners delen hun GPS-locatie op een instelbaar tijdsinterval;
  • Jagers ontvangen de locatie-updates van Renners via de App;
  • Beheer van spelparameters zoals het locatie-interval.

4. Veiligheid — Belangrijk

Gebruik de App NOOIT terwijl u rijdt, fietst of in een situatie verkeert die uw volledige aandacht vereist. Let altijd op uw omgeving tijdens het gebruik van de App. U bent te allen tijde zelf verantwoordelijk voor uw eigen veiligheid en die van anderen.

Door de App te gebruiken erkent u dat:

  • Locatie-, richting- en afstandsgegevens vertraagd, onnauwkeurig of incorrect kunnen zijn;
  • De App uitsluitend bedoeld is voor entertainment en niet voor navigatie, noodgevallen of veiligheidskritische doeleinden;
  • U verantwoordelijk bent voor uw omgeving en uw eigen beslissingen;
  • U geen verboden terreinen betreedt, niet trespasst en de wet niet overtreedt.

Wij zijn niet aansprakelijk voor letsel, schade aan eigendommen of enig ander incident dat voortvloeit uit het gebruik van de App of deelname aan het spel. De Aanbieder aanvaardt geen enkele verantwoordelijkheid voor schade van welke aard dan ook die ontstaat tijdens of als gevolg van het gebruik van de App.

5. Locatietracking

5.1 Toestemming

Voor het functioneren van de App is toegang tot de GPS-locatie van uw apparaat vereist. Door deel te nemen als Renner geeft u expliciet toestemming voor het delen van uw locatie met de Jagers binnen uw spelsessie, gedurende de duur van het spel.

5.2 Interval en controle

Locatie wordt niet continu gedeeld, maar op een instelbaar tijdsinterval. De spelorganisator of Renner kan dit interval instellen in de App. Buiten een actieve spelsessie wordt uw locatie niet gedeeld of opgeslagen.

5.3 Nauwkeurigheid

GPS-locatiegegevens kunnen vertraagd of onnauwkeurig zijn door technische beperkingen (signaalsterkte, netwerk, apparaat). Wij geven geen garanties over de nauwkeurigheid van locatiegegevens.

5.4 Derden

Uw locatiegegevens worden uitsluitend gedeeld met de Jagers in uw actieve spelsessie. Wij verkopen of verstrekken uw locatiegegevens niet aan derden voor commerciële doeleinden.

6. Verwerking van Persoonsgegevens (AVG)

Wij verwerken uw persoonsgegevens conform de Algemene Verordening Gegevensbescherming (AVG). De volgende gegevens kunnen worden verwerkt:

  • Gebruikersnaam of naam;
  • E-mailadres (indien opgegeven bij registratie);
  • GPS-locatiegegevens (uitsluitend tijdens actieve spelsessies);
  • Apparaatinformatie en technische loggegevens.

Locatiegegevens die zijn opgeslagen als onderdeel van de match history worden maximaal 7 dagen bewaard na afloop van de spelsessie, waarna ze automatisch worden verwijderd. Andere persoonsgegevens worden niet langer bewaard dan noodzakelijk voor het doel waarvoor zij zijn verzameld. U kunt uw rechten uitoefenen (inzage, correctie, verwijdering) via de contactgegevens in artikel 14.

6.1 Match History en delen met vrienden

Na afloop van een spelsessie wordt een samenvatting van de spellocaties opgeslagen als match history. Deze match history is zichtbaar voor gebruikers die u als vriend heeft toegevoegd binnen de App. U kunt zelf bepalen wie u als vriend toevoegt. Door iemand als vriend toe te voegen, geeft u toestemming dat deze persoon uw match history kan inzien.

Match history-gegevens worden automatisch verwijderd na 7 dagen. Wij verstrekken deze gegevens niet aan derden buiten uw vriendenlijst.

7. Accounts en Beveiliging

Bepaalde functies vereisen een account. U bent verantwoordelijk voor:

  • Het beveiligen van uw inloggegevens en apparaat;
  • Alle activiteit onder uw account;
  • Het verstrekken van juiste informatie aan de App.

Wij behouden ons het recht voor accounts te weigeren, te schorsen of te beëindigen ter bescherming van de App, andere gebruikers of onszelf, dan wel indien dit wettelijk vereist is.

8. Toegestaan Gebruik

U stemt ermee in de App niet te gebruiken voor:

  • Illegale doeleinden of het aanmoedigen daartoe;
  • Het lastigvallen, bedreigen of beledigen van andere gebruikers;
  • Het nabootsen van anderen of het misrepresenteren van uw identiteit;
  • Valsspelen, waaronder GPS-spoofing, automatisering of het omzeilen van spelregels;
  • Het interfereren met of overbelasten van de App;
  • Het misbruiken van persoonsgegevens of locatiegegevens van andere spelers.

Wij kunnen overtredingen handhaven naar eigen inzicht, inclusief het verwijderen van inhoud, het beperken van functies of het schorsen/beëindigen van accounts.

9. Intellectueel Eigendom

Alle rechten op de App — inclusief software, ontwerp, branding en de naam "Hide" — zijn eigendom van de Aanbieder of diens licentiegevers. U ontvangt een beperkte, persoonlijke, herroepelijke, niet-overdraagbare licentie voor niet-commercieel gebruik van de App.

Het is niet toegestaan de App te kopiëren, te wijzigen, te distribueren, te verkopen of te reverse-engineeren, tenzij dwingend recht dit toestaat.

10. Beschikbaarheid en Wijzigingen

Wij streven naar een zo hoog mogelijke beschikbaarheid, maar garanderen geen ononderbroken werking. Wij behouden ons het recht voor de App op elk moment te wijzigen, te beperken of stop te zetten. Wij zijn niet aansprakelijk voor schade als gevolg van niet-beschikbaarheid.

11. Beëindiging

U kunt de App op elk moment stoppen met gebruiken en verwijderen van uw apparaat. Wij kunnen uw toegang op elk moment beëindigen of beperken, met of zonder kennisgeving, onder meer bij vermoeden van schending van deze voorwaarden of om veiligheids- of wettelijke redenen.

12. Wijzigingen in de Voorwaarden

Wij kunnen deze Gebruiksvoorwaarden periodiek aanpassen. Bij wezenlijke wijzigingen informeren wij u via de App of per e-mail. Voortgezet gebruik na de ingangsdatum van de gewijzigde voorwaarden geldt als aanvaarding. De meest actuele versie is beschikbaar via de App.

13. Toepasselijk Recht en Geschillen

Op deze Gebruiksvoorwaarden is Nederlands recht van toepassing. Eventuele geschillen worden voorgelegd aan de bevoegde rechter in het arrondissement waar de Aanbieder is gevestigd, tenzij dwingend recht anders bepaalt.
